3. Collection and storage of personal data as well as the method and purpose of their processing, relevant legal basis and storage period

3.2. Additional services and career opportunities

Providing further (additional) personal data is voluntary. There will be no negative consequences for you if you do not provide us with further personal data. However, as the controller, we need your personal data for each of the following processing operations in order to be able to act. In these cases, we cannot provide the service you have requested without using the personal data required for this purpose.

Your data will be deleted after your request has been processed, unless further storage is necessary, e.g. if we have concluded a contract with you. In this case, we process your data on the basis of Article 6 Paragraph 1 Letter b) GDPR.

We process the aforementioned data in order to provide you with current information about our services, based on your consent in accordance with Art. 6 Para. 1 lit. a) GDPR.

3.2.2. Career opportunities

If you are interested in working with us, you have the opportunity to apply. If you send us your application documents such as a cover letter, CV and certificates in digital form for this purpose, we will process the personal data transmitted as part of the application process for the purpose of deciding on the establishment of an employment relationship with you, including notification of acceptance or rejection. The legal basis for processing your data for this purpose is Art. 88 GDPR in conjunction with Section 26 Paragraph 1 of the Federal Data Protection Act (BDSG).

If we enter into an employment relationship with you, we will also process your personal data, which we have processed as part of the recruitment process, for the purpose of carrying out or terminating the employment relationship. The legal basis in this case is Art. 88 GDPR in conjunction with Section 26 Paragraph 1 of the Federal Data Protection Act (BDSG). The relevant data protection information for our employees is provided separately and is not the subject of this data protection declaration.

In addition, we also process your personal data that we collected as part of the application process to fulfill legal obligations on the basis of Art. 6 Para. 1 lit. c) GDPR and on the basis of Art. 1 lit. f) GDPR Safeguarding our legitimate interests, namely to establish, exercise and/or defend legal claims (e.g. with regard to possible claims that may arise from the General Equal Opportunities Act (AGG)).

If your application documents contain special categories of personal data within the meaning of Article 9 Paragraph 1 GDPR, we assume that you expressly consent to the processing of these data within the meaning of Article 9 Paragraph 2 Letter a) GDPR, unless otherwise stated In individual cases, a different exception applies (e.g. Art. 9 Para. 1 lit. b) GDPR in conjunction with Section 26 Para. 3 Federal Data Protection Act (BDSG) or Art. 9 Para. 2 lit. h) GDPR in conjunction with Section 22 Para. 1 Sentence 1 lit. b) Federal Data Protection Act (BDSG)).

If we reject your application, your data will be deleted 6 months after this point in time in accordance with Section 61b Subparagraph 1 of the Labor Court Act (ArbGG) in conjunction with Section 15 of the General Equal Opportunities Act (AGG), unless further processing of this data is necessary for justification and/or defense of legal claims required. The data of the applicants we hire will be processed for as long as is necessary to establish, carry out or terminate the employment relationship.

4. Storage period

5. Recipients or categories of recipients of your personal data

We sometimes use external service providers (e.g. IT service providers) to process your data. In some cases, these service providers process your personal data as data processors on our behalf, according to our instructions and under our supervision, exclusively for the purposes described in this data protection declaration in accordance with Art. 28 GDPR, and in some cases they act as independent controllers. 6. Social Plugins

On our website we offer you the opportunity to use so-called “social media buttons”. To protect your data, we rely on the “Shariff” solution for implementation. 7. Transfer of data to third countries

Your personal data may be transferred or disclosed to third party companies located outside the European Economic Area (EEA), i.e. h. in third countries. This affects the use of the following services:

8. Data security

All personal data you provide is transmitted using the secure and proven SSL (Secure Socket Layer) standard. In addition, we use appropriate technical and organizational security measures to protect stored personal data against manipulation, partial or complete loss and unauthorized access by third parties. Our security measures are continuously improved in line with technological developments. In particular, we ensure that sensitive personal data is only stored on servers that are hosted in the EU and that are certified according to DIN ISO/IEC 27001 (as amended).

9. Your rights

In connection with the processing of your personal data by us, you have the following rights free of charge:

9.1. Right to information in accordance with Art. 15 GDPR

You have the right to receive information from us about whether and what data we process about you. This includes information about how long and for what purpose we process the data, the source of the data and the recipients or categories of recipients to whom we pass on the data. We may also provide you with a copy of this information.

9.2. Right to correction in accordance with Art. 16 GDPR

You have the right to have us immediately correct any information about you that is inaccurate or no longer accurate. In addition, you can request that we complete your incomplete personal data. Where required by law, we will also inform third parties of this correction if we have shared your personal data with them.

9.3. Right to deletion in accordance with Art. 17 GDPR

You have the right to request that we delete your personal data immediately if one of the following applies:

  • you withdraw your consent and there is no other legal basis for the processing;

9.4. Right to restriction of processing in accordance with Art. 18 GDPR

You have the right to ask us to restrict the processing of your personal data if one of the following reasons applies:

  • you contest the accuracy of your personal data for a period enabling us to verify the accuracy of the personal data;
  • The processing is unlawful and you object to the deletion of the personal data and instead request the restriction of the use of your personal data;
  • Your personal data is no longer needed for the purposes of processing, but you need it to assert, exercise or defend legal claims, or
  • You have objected to the processing until it is clear whether our legitimate reasons outweigh yours.

If you have obtained a restriction on processing in accordance with the points above, we will inform you before the restriction is lifted.

9.5. Right to data portability in accordance with Art. 20 GDPR

You have the right to receive the personal data relating to you that you have provided to us in a structured, commonly used and machine-readable format and to transmit this data to others. Exercising this right does not affect your right to deletion.

9.6. Right to object in accordance with Art. 21 GDPR

According to Art. 21 GDPR, you have the right in particular to object to the processing of your data at any time for reasons arising from your particular situation if we are carrying out this processing based on legitimate interests in accordance with Art. 6 Para. 1 lit. f) GDPR support. If you object, we will no longer process your personal data, except in two cases:

  • We can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms; or
  • The processing serves to assert, exercise or defend legal claims.

In particular, if we process your personal data for direct marketing, you have the right to object at any time to the processing of your data for the purposes of such marketing. If you object to the processing of your data for direct marketing purposes, we will no longer use your personal data for this purpose.

9.7. Right to revoke consent in accordance with Art. 7 GDPR

You can revoke the consent you have given us at any time with future effect. This revocation can take place in the form of an informal message to the contact addresses mentioned above. The revocation of consent does not affect the lawfulness of the data processing that has taken place up to this point.

10. Automated decisions including profiling in accordance with Art. 22 GDPR

We do not process your data for automated decisions in individual cases, including profiling within the meaning of Art. 22 GDPR.
